1. Acceptance of Terms: By accessing or using the Ezys website ("Site"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, please do not use the Site.
2. Use of Site: The Site is intended for personal, non-commercial use only. You may not use the Site for any unlawful purpose or in violation of these Terms.
3. Intellectual Property: All content on the Site, including text, graphics, logos, images, and software, is the property of Ezys or its licensors and is protected by copyright and other intellectual property laws.
4. User Content: By submitting content to the Site, you grant Ezys a non-exclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content.
5. Privacy Policy: Your use of the Site is subject to Ezys' Privacy Policy, which is incorporated into these Terms by reference. Please review the Privacy Policy carefully to understand how we collect, use, and disclose information about you.
6. Disclaimer of Warranties: The Site is provided "as is" and "as available" without any representations or warranties of any kind, express or implied. Ezys does not warrant that the Site will be uninterrupted or error-free, or that defects will be corrected.
7. Limitation of Liability: In no event shall Ezys be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with your use of the Site or these Terms, even if advised of the possibility of such damages.
8. Minimum Age Requirement: To rent products from Ezys, you must be at least 21 years of age. Orders will only be fulfilled after validating a government-issued ID proof to confirm your age.
9. Rental Duration: Our rental duration ranges from 1 to 30 days. No extensions will be granted beyond 30 days under any circumstances.
10. Governing Law and Jurisdiction: These Terms shall be governed by and construed by the laws of Hyderabad, India, without regard to its conflict of law provisions. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in Hyderabad, India.
11. Changes to Terms: Ezys reserves the right to modify or revise these Terms at any time without prior notice. Your continued use of the Site after any changes to these Terms will constitute your acceptance of such changes.
12. Non-Return of Items and Legal Action:
Return Obligations: All rented items must be returned by the agreed-upon return date as stated in the mail communication shared. Failure to return the rented items within the stipulated time, without communication or justification, will be considered a breach of this contract.
Consequences of Non-Response: If you fail to respond to our requests regarding overdue items, Ezys reserves the right to escalate the matter, including but not limited to sending formal notices. In case of continued non-compliance, Ezys will pursue legal action.
Legal Action: Failure to return the items or respond within a reasonable timeframe may result in legal proceedings, including but not limited to filing an FIR (First Information Report) under applicable sections of fraud, cheating, and recovery of the rented goods. Any financial losses, damages, or legal costs incurred as a result of such actions will be borne by the customer.
Recovery of Costs: Ezys reserves the right to recover any additional costs arising due to the non-return or damage to the items, including transportation and legal fees.
13. Issue Reporting and Rental Payment Calculation:
Reporting a Problem: If a customer reports an issue with the rented product during the rental period, Ezys will inspect the product upon its return to verify the issue.
Genuine Issues: If the reported issue is found to be genuine after inspection, the rental fee will be recalculated based on the per-day price. Since Ezys operates a rental model where the per-day cost decreases with longer rental durations, the customer will be charged according to the reduced per-day rate for the days the product was in use until the issue was reported.
Example: If an item was rented for 10 days at ₹2,000 and a genuine issue is reported on Day 6, the rental fee will be recalculated based on the per-day rate for the 5-day duration (e.g., ₹200/day), resulting in a charge of ₹1,000 for 5 days, with the remaining amount refunded.
Invalid Issues: If no issue is found after inspection, the customer will be charged for the full rental duration as per the rates mentioned on the Ezys website for that rental period.
Example: If the same item was rented for 10 days at ₹2,000, and the issue is reported on the 6th day but found to be invalid, the rental will be charged at the full 5-day rate (e.g., ₹1,500), as mentioned on the website.
Refund Policy: Refunds will be processed based on the recalculated rental amount, considering the validity of the reported issue and the applicable per-day rental rate. Refunds will be processed within 3 business days after the product has been inspected.
Limitation of Liability: Ezys is not liable for any indirect or consequential damages arising from reported product issues. Any refunds or adjustments to the rental fees are limited to the rental fees paid by the customer for the period in question.
